K9s For Warriors ("K9sFW") is a nonprofit organization headquartered in Ponte Vedra, Florida. Hosting a third-party event for K9sFW is an opportunity to contribute time, talent, energy, funds, and compassion to the service of veterans and the rescue of dogs.
In consideration of my desire to serve as a third-party event host ("Host") for K9s For Warriors, which includes the hosting of my main registered event, and any other supporting event connected to my main event (the "Event"), I, for myself and my heirs, executors, representatives, administrators, and assigns, hereby acknowledge and agree as follows:
Inherent Risks and Assumption of Risk. I understand and acknowledge there are inherent risks associated with participating in such Host activities that include, but are not limited to, property damage, bodily or personal injury, infection or death caused by trips, slips, falls, accidents, equipment failure, negligent security, faulty products, and/or exposure to viruses and airborne pathogens. Further, I understand and acknowledge that if my Host activities involve the presence of, interaction with, or handling of canines, that canines, by their very nature, are subject to animal whim and may react unpredictably when introduced to different people and situations, and as a result may cause injury. The inherent risks include, but are not limited to, the propensity of canines to run, pull, tug, yank, lung, jump, scratch, and bite, that may cause harm, injury, or even death in rare circumstances, to persons around or handling them.
Further, I understand and acknowledge that any and all of the aforementioned and associated risks of Host, Event, volunteer, and/or canine activities may result from the actions, omissions, or negligence of myself and others, including, but not limited to, K9sFW, its officers, directors, employees, agents, volunteers and program participants, and I expressly assume all responsibility for any and all of the aforementioned risks, even if caused by the negligence of K9s For Warriors or its officers, directors, employees, agents and volunteers.
Further, I understand and acknowledge that K9s For Warriors' insurance will not cover the Event, nor will it be listed as a co-insured for the Event.
Full and Complete Release. I, for myself and my heirs, executors, representatives, administrators and assigns, hereby expressly release, waive, and discharge K9s For Warriors and its officers, directors, employees, agents, and volunteers from any and all claims for property damage, bodily or personal injury, infection, death, damages, costs, and expenses on account of, by reason of, or arising in connection with such Host, Event, volunteer, and/or canine activities, even if caused by the negligence of K9s For Warriors or its officers, directors, employees, agents and volunteers.
Indemnification. I expressly agree to hold harmless, indemnify, and defend K9s For Warriors against and from any and all claims, demands, causes of action, damages, judgments, orders, costs or expenses, including attorney's fees, whether actually incurred or not, which may in any way arise from or be in any way connected with said Host, Event, volunteer, and/or canine activities.
Severability. I expressly agree that this liability waiver, release, and indemnification agreement is intended to be as broad and inclusive as permitted by the State of Florida, and that if any portion thereof is held invalid, it is agreed that the balance shall, notwithstanding, continue in full legal force and effect.
Governing Law. The validity, interpretation, and construction of this liability waiver, release, and indemnification agreement, and all other matters related to this liability waiver, release, and indemnification agreement, shall be governed by the laws of the State of Florida.
I HAVE CAREFULLY READ THE FOREGOING LIABILITY WAIVER, RELEASE, AND INDEMIFICATION AGREEMENT, AND UNDERSTAND THE CONTENTS THEREOF AND FREELY, KNOWINGLY, AND VOLUNTARILY SIGN THIS AGREEMENT AS MY OWN FREE ACT.
